Privacy Policy

2. Data We Collect

We collect personal data that you voluntarily provide through our contact forms, including your full name, email address, and project requirements. We also collect technical data automatically through essential cookies, including your IP address (anonymized), browser type, device identifiers, and page interaction metrics necessary for site functionality.

3. Purpose of Processing

Your personal data is processed exclusively for the following purposes: (a) responding to your inquiries and service requests, (b) delivering contracted digital engineering services, (c) maintaining site security and functionality, (d) complying with legal obligations under EU and Spanish data protection law. We do not engage in automated decision-making or profiling that produces legal effects concerning you.

4. Legal Basis

Processing is based on Article 6(1)(b) GDPR (contractual necessity) for service delivery, Article 6(1)(f) (legitimate interest) for site security, and Article 6(1)(a) (consent) for analytics cookies. You may withdraw consent at any time without affecting the lawfulness of processing based on consent before its withdrawal.

5. Data Retention

Contact form submissions are retained for 24 months from the last interaction. Service-related data is retained for the duration of the contractual relationship plus 5 years as required by Spanish commercial law. Analytics data is retained in anonymized form for 38 months. All data is securely deleted upon expiration of the retention period.

6. Your Rights

Under the General Data Protection Regulation (EU) 2016/679, you have the right to: access your personal data (Article 15), rectify inaccurate data (Article 16), erase your data (Article 17), restrict processing (Article 18), data portability (Article 20), and object to processing (Article 21). 7. International Transfers

If data is transferred outside the European Economic Area, we ensure appropriate safeguards are in place through Standard Contractual Clauses approved by the European Commission or adequacy decisions. Our primary data processing occurs within EU-based infrastructure.

8. Security Measures

We implement appropriate technical and organizational measures including TLS/SSL encryption for all data transmissions, access controls limiting data processing to authorized personnel, regular security audits, and incident response procedures in compliance with Article 32 GDPR.

Refund Policy

1. Scope

This Refund Policy applies to all digital engineering services provided by FjordSignalWorks as described in our service catalog and individual project agreements.

2. Milestone-Based Refunds

All projects are structured around defined milestones. Refund eligibility is determined by the project phase at the time of cancellation: (a) Pre-commencement: Full refund minus a 10% administrative fee if cancellation occurs before any work begins. (b) Phase 1 completion: Refund of 50% of the remaining balance after Phase 1 deliverables have been accepted. (c) Phase 2 or later: No refund for completed phases; remaining undelivered work is refunded proportionally.

3. Refund Processing

Approved refunds are processed within 14 business days to the original payment method. Refunds are issued in euros (€). Any bank transfer fees or currency conversion costs are borne by the client.

4. Disputes

If you are dissatisfied with deliverables, you must notify us in writing within 7 business days of delivery. We will work in good faith to resolve the issue through revision cycles as specified in your project agreement. Unresolved disputes are subject to the jurisdiction of the courts of Barcelona, Spain.

5. Non-Refundable Items

The following are non-refundable: third-party software licenses procured on your behalf, domain registrations, hosting setup fees, and completed deliverables that have been formally accepted by the client in writing.

Terms of Service

1. Agreement

By engaging FjordSignalWorks for digital engineering services or using this website, you agree to be bound by these Terms of Service. These terms constitute a legally binding agreement between you ("Client") and FjordSignalWorks, a company registered in Spain with offices at 08001, Carrer de Pelai 12, Barcelona, Spain.

2. Services

FjordSignalWorks provides digital engineering services including but not limited to website design, development, performance optimization, SEO engineering, API integration, and digital transformation consulting. The specific scope, deliverables, and timelines for each engagement are defined in individual project agreements or statements of work.

3. Payment Terms

Unless otherwise agreed in writing, payment terms are as follows: 40% deposit upon project commencement, 30% at midpoint milestone, and 30% upon final delivery. All prices are quoted in euros (€) and are exclusive of VAT where applicable. Late payments are subject to a 1.5% monthly interest charge in accordance with Spanish law (Ley 3/2004).

4. Intellectual Property

Upon full payment, the Client receives full ownership and intellectual property rights to all custom deliverables created specifically for the project. FjordSignalWorks retains ownership of any pre-existing frameworks, tools, libraries, and methodologies used in the creation of deliverables. FjordSignalWorks reserves the right to showcase completed work in its portfolio unless a non-disclosure agreement specifies otherwise.

5. Limitation of Liability

FjordSignalWorks's total liability under any agreement shall not exceed the total fees paid by the Client for the specific service giving rise to the claim. We shall not be liable for indirect, incidental, consequential, or punitive damages, including loss of profits, data, or business opportunities, except in cases of gross negligence or willful misconduct.

6. Confidentiality

Both parties agree to maintain the confidentiality of proprietary information shared during the engagement. This obligation survives the termination of the agreement for a period of 3 years. Exceptions apply to information that is publicly available, independently developed, or required to be disclosed by law.

7. Termination

Either party may terminate an engagement with 14 days written notice. Upon termination, the Client is responsible for payment of all work completed up to the termination date. FjordSignalWorks will deliver all completed work products and work-in-progress materials within 10 business days of termination.

8. Governing Law & Jurisdiction

These Terms of Service are governed by and construed in accordance with the laws of the Kingdom of Spain. Any disputes arising from or relating to these terms shall be subject to the exclusive jurisdiction of the courts of Barcelona, Spain. The parties agree to attempt mediation before pursuing litigation.
